Terms of Service
Last updated: October 18, 2026
1. Who we are and what these terms cover
filmaris is an AI-assisted film creation platform: you write a script or import a screenplay or book, the platform helps you turn it into a storyboard, generates images, video clips and audio via AI models, and lets you edit and export the result as a finished video. These Terms of Service ("Terms") govern your use of the filmaris website and services ("Service"). Your contract partner is the operator identified in the Imprint. Upon its registration in the commercial register, filmaris GmbH, Lohengrinstr. 21, 42477 Radevormwald, takes over this contract in place of the current operator; we will inform you, and you may terminate the contract at any time.
2. Your account; consumers and businesses
- You must be at least 18 years old (or the age of legal majority in your country) to use the Service.
- You must provide accurate registration information and keep your login credentials confidential. You are responsible for activity under your account.
- Accounts are personal and may not be shared or sold.
- You are a "consumer" if you use the Service mainly for purposes outside your trade, business or profession; otherwise you are a "business". Where these Terms say "if you are a consumer" or "if you are a business", the rule applies only to that group.
- You confirm that you are not listed on, or owned or controlled by a person listed on, an EU, UN, UK or US sanctions list, and that you do not use the Service from a sanctioned territory.
- Organisations with 10 or more employees or more than €2 million annual revenue may use the Service commercially only on a Team or Enterprise plan that covers everyone who uses the Service for them; organisations with 250 or more employees or more than €50 million annual revenue only on an Enterprise plan. Affiliated companies count together. Individuals, freelancers and smaller organisations may use any plan commercially.
3. How the contract is concluded
You create an account by entering your e-mail address and a password (or signing in with a supported provider), accepting these Terms and the characteristics of AI outputs (section 5), and confirming that you are at least 18. Before you submit, you can correct every entry in the form. The contract is concluded when you confirm your e-mail address or first sign in. We store the text of the Terms you accepted and send it to you by e-mail after you accept them; earlier versions stay available on request. The contract language is English.
4. Credits, prices and payment
- Paid features (AI generation, rendering, upscaling) consume prepaid credits. The credit price of an action is shown before you start it.
- Purchases are processed by a merchant of record — Paddle or Stripe (Stripe Managed Payments). The merchant of record sells to you in its own name and handles checkout, payment methods, invoices, applicable taxes and statutory withdrawal under its own terms; we never receive or store your full payment card details.
- If a generation fails, the reserved credits for that generation are automatically refunded to your balance, except for the part the AI provider charges us for the failed request (for example when computing time was already used); that part is deducted at the provider's actual cost. Credits spent on successfully delivered results are not refunded.
- Credits are not transferable and have no cash value outside the Service. For refunds of credit purchases, see the Refund Policy.
- If you connect your own AI provider API keys (bring your own key), the AI cost of generations made with those keys is billed directly by the respective provider under its terms; each such generation additionally consumes filmaris credits for the use of the platform, as shown before you start it; a generation that fails consumes no filmaris credits. Your keys are stored encrypted and used only to perform the generations you request.
5. Your content and rights
- As between you and filmaris, you own and retain all right, title and interest in and to the content you upload or enter into the Service — scripts, prompts, uploads and imported texts ("Your Input"). Your Input, the outputs generated for you, your projects and exported films are together "Your Content".
- You grant us the technical license needed to operate the Service: storing, processing, transmitting to the AI providers you invoke, rendering and displaying Your Content back to you. Beyond that, we claim no rights to it except the showcase license below.
- Showcase license. On plans whose AI-generated media are marked Public on the pricing page (currently Free and Starter), you grant filmaris a non-exclusive, worldwide, royalty-free and perpetual license to show the films you export — in full or in excerpts — on filmaris.com, on filmaris social media channels and in filmaris advertising, and to keep a copy for this purpose, also after your account is deleted. On plans with private media (Pro and above), the same license applies only to films you release for the showcase when exporting. Films whose project contains your own uploads are never covered. filmaris decides which films, if any, it shows; there is no claim to be shown and no payment. A film is shown without your name. Films covered by this license are not removed on request; we remove a film only if it contains illegal content or infringes the rights of third parties (section 7). For a film made from an imported book or screenplay, you confirm that your rights in the text include allowing this showcase use. We show this license to you when you choose a plan and when you export.
- You are responsible for Your Content. You confirm that you hold the necessary rights to everything you upload (footage, images, audio, likenesses of persons) and that Your Content does not violate applicable law or third-party rights.
- Imported books and screenplays. You may only import a book or screenplay you hold the right to adapt into a film — as its author with the film rights not assigned to anyone else, through a license, or because the work is in the public domain. You confirm this for every imported file. We use an imported text only to write your screenplay and build your project, and for nothing else. You can delete an imported file at any time; films you make from it follow the showcase license above like any other film.
- Imported songs. You may only import a song you hold the right to use in a film, for the recording as well as for the music and lyrics: as their author with these rights not assigned to anyone else, through a license, or because the work is in the public domain. You confirm this for every imported file. We use an imported song only to write your screenplay, to build your project and as the music of your film, and for nothing else. An imported song counts as your own upload.
- AI outputs. Images, video, audio and texts generated for you ("Outputs") are produced automatically by third-party AI models from your inputs. You may use Outputs, including commercially — for example in films you sell; if you use your own fal.ai API key, your own agreement with fal.ai governs. We claim no rights in Outputs. Due to the nature of AI, Outputs may not be unique across users, and the AI models may generate the same or similar Outputs for other users. The AI models are not error-free, may not work as expected, and may generate Outputs that are inaccurate, do not match your prompt, or resemble existing works, characters, trademarks or persons. Whether you may use an Output without infringing third-party rights depends on its content and your use; check this before publishing or exploiting it. The extent of copyright protection for AI-generated material varies by jurisdiction. You are responsible for how you use Outputs and exported results.
- If you are a consumer: these characteristics of Outputs were agreed with you expressly and separately before you created your account (or accepted these Terms); your statutory rights for defects otherwise remain unaffected.
- If you are a business: we do not represent or warrant that any Output will be original, will not infringe rights of any third party (including intellectual property rights), or otherwise entitle you to any intellectual property rights in any Output.
- AI marking. Outputs and exported films carry a machine-readable marking identifying them as AI-generated. You must not remove, alter or obscure it. If you publish an Output that depicts real persons, objects, places or events and could falsely appear authentic (a "deep fake"), you must clearly disclose that it was artificially generated or manipulated; for evidently artistic, creative, satirical or fictional works this may be done in a way that does not hamper the enjoyment of the work, for example in the credits.
- Feedback. If you send us comments, ideas or suggestions about the Service ("Feedback"), we may use them for any purpose, commercial or otherwise, without acknowledgment or compensation to you, including to develop and improve the Service. We may treat Feedback as non-confidential.
- The license status shown for a model in the Service is provided for convenience — it is not legal advice.
- Brand neutralisation. filmaris neutralises real-world brands in scripts and generated media on a best-effort basis; it can miss brands and can be switched off per project. Where it is off or misses a brand, brands from your inputs remain in your project, and their use is your responsibility. Confirmations your customers give on review pages are made to you; they do not change your responsibility towards us.
6. Acceptable use
You must not use the Service to:
- create or distribute content that is illegal, defamatory, or infringes intellectual-property, personality or privacy rights;
- create sexual content involving minors, non-consensual intimate imagery, or deceptive impersonations of real persons;
- create sexually explicit or pornographic content, or any other material intended for sexual arousal;
- depict a real person's name, image, voice or other likeness without their consent (including deepfakes), or impersonate anyone;
- promote or support terrorism or violent extremism, human trafficking, sexual violence, self-harm or suicide;
- threaten, harass or bully anyone, incite violence, or create hate speech or content that discriminates against people for a legally protected characteristic;
- create gratuitously violent content, extreme gore, or depictions of torture, mutilation or animal abuse;
- create deliberately deceptive misinformation likely to harm public health, public safety, elections or civic participation, or use the Service for fraud, scams or spam;
- create content about illegal or regulated goods and activities, or for any other criminal purpose;
- enter personal data of real, living persons — names, addresses, contact details or other details that identify them — in prompts, scripts or any other text field, unless the person is you or has explicitly consented;
- circumvent technical limits (rate limits, quotas, security measures), probe or disrupt the Service, access other users' data, introduce malicious code, or try to extract or reverse-engineer the AI models;
- use the Service or any Outputs to develop, modify, fine-tune, train or improve any artificial-intelligence model, or any product or service that competes with the AI models or with the Service;
- reproduce, redistribute or make available any training data of the AI models, or generate or use content in a way that replicates or closely mimics the original assets used to train them;
- use the Service from a territory under sanctions;
- resell or provide the Service to third parties as your own offering without our written consent.
7. Reporting content and moderation
Anyone can report content they consider illegal via our report form, stating the reasons, where exactly the content is, their name and e-mail address (not required for reports of child sexual abuse material) and that the report is made in good faith. We confirm receipt and inform the reporter of our decision. The AI providers apply automated safety filters and may refuse a generation for policy reasons. Reports are reviewed by a person; we take no decision about your content or account solely by automated means. Our measures, applied diligently, objectively and proportionately: refusing a generation, removing or disabling content, removing a film from the showcase, suspending or terminating an account. If we restrict your content or account, we tell you the reasons and how you can challenge the decision (reply to us for a review by a person, or go to court). Our single point of contact for authorities and users is given in the Imprint.
8. Third-party AI providers
Generations are performed by third-party AI models (fal.ai, OpenRouter, Anthropic, OpenAI, Google, xAI, DeepSeek models, Black Forest Labs, Ideogram, Recraft, ByteDance, MiniMax, Kling, Lightricks, Pika, Topaz Labs, Vidu, Alibaba Cloud, ElevenLabs), all provided through fal.ai. When you start a generation, the prompt and any text or reference media required for it are transmitted through fal.ai to the selected model's provider. The Service Providers page lists every provider with its location. Model availability, quality and output characteristics depend on these providers and may change. We select and update the available models at our discretion.
All AI models are provided through fal.ai (Features & Labels, Inc.). When filmaris runs a generation on its own fal.ai account, fal.ai processes the data as our processor under its Data Processing Addendum; when you connect your own fal.ai API key, your own agreement with fal.ai applies. In both cases fal.ai’s terms provide, as of 2 October 2026, in summary: fal.ai does not use inputs or outputs to train or develop its products or services (it may use anonymized, aggregated usage data), and every model we offer is marked “Commercial use” by fal.ai, so its outputs may be used commercially. This is a summary for information; for fal.ai’s own commitments, fal.ai’s current documents are authoritative.
fal.ai Terms of Service · fal.ai Data Processing Addendum · fal.ai API Services Terms
This summary is information about our supplier; it does not make fal.ai's terms part of our agreement with you. Our own rules for using the Service are in section 6.
9. Use of generation data
To operate, maintain, and improve the Service, filmaris records technical data about generations — the generation prompts (short texts for single images, clips and sounds, usually written by our platform from your project, sometimes edited or written by you), generation settings, model outputs, quality-review results, and your accept/reject choices. We may use this data in anonymized and aggregated form — with personal identifiers and account references removed — to improve generation quality, evaluate and train quality-assessment systems, and compile statistical model benchmarks. Projects that belong to an organisation on a Team or Enterprise plan are excluded: we use their data only to provide the Service. Your scripts, imported books and screenplays and your uploads themselves are not part of this data: we store and use them only to provide the Service to you. What fal.ai may do with the data it receives for a generation is described in section 8. You can delete your account at any time (section 10); what is kept afterwards is described in our Privacy Policy.
10. Storage and deletion
- Your projects and media are stored for you subject to the storage quota of your plan. Uploads are limited in size; oversized or unsupported files may be rejected.
- Deleted items go to a trash area first and can be restored for 14 days; after that, or when you empty the trash, they are removed permanently.
- You can delete your account at any time in your account settings. The deletion takes effect after 14 days — logging in before then restores the account — or immediately if you choose so. Any subscription of your own ends with the deletion; a Team or Enterprise plan you bought for an organisation keeps running for the organisation while it has other members, and stays billed to your payment method until an owner ends it. Refunds follow the Refund Policy, and remaining credits are lost.
- When your account is deleted, your projects, scripts, uploads, generated media and exports are deleted, except films covered by the showcase license (section 5), which are kept without any reference to your account. Anonymized generation data and billing records are kept as described in the Privacy Policy.
11. Availability, maintenance and changes to the Service
- We aim for high availability but do not guarantee uninterrupted operation. The Service depends on third-party infrastructure and AI providers (for example fal.ai and our hosting, storage and delivery providers); outages of these providers, and outages of our own servers, can make the Service or individual features temporarily unavailable.
- We may carry out scheduled maintenance for up to 8 hours per week, during which the Service may be unavailable. We announce scheduled maintenance at least 48 hours in advance in your account. Urgent security maintenance may happen without notice.
- If you are a consumer: we may change the Service beyond what is needed to keep it in conformity for a valid reason — in particular new technology, changes to or discontinuation of AI models by our suppliers, legal requirements or security — at no extra cost to you, and we will inform you clearly. If a change impairs your access to or use of the Service more than insignificantly, we will inform you by e-mail in good time beforehand, and you may terminate the contract free of charge within 30 days of the information or the change, whichever is later; we then refund unused paid credits and the unused part of a prepaid period.
- If you are a business: we may change the Service for a valid reason (changes in law, our suppliers' terms, new features, security), provided the balance between performance and price does not shift to your disadvantage.
12. Liability
- We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act and other mandatory statutory liability, for defects we fraudulently concealed and under any guarantee we gave.
- For slight negligence we are liable only for the breach of an obligation whose fulfilment makes the proper performance of the contract possible at all and on which you may regularly rely, limited to the damage foreseeable and typical for this type of contract.
- If you are a business, our liability for slight negligence is further limited per event to the greatest of (i) the fees you paid us in the 12 months before the event, (ii) the price you paid for the credits spent on the project(s) affected by the event, and (iii) EUR 500.
- Any further liability for slight negligence is excluded. These rules also apply to our employees and agents.
- If you are a consumer, your statutory rights for defects of digital products and the mandatory rights under the law of your country of habitual residence remain unaffected.
13. Indemnity
- If you are a consumer: if a third party asserts claims against us because Your Content or your use of the Service infringes its rights or the law, you indemnify us against these claims to the extent you are responsible for the infringement, including the necessary costs of our legal defence at statutory fee rates. We will inform you of the claim without delay, let you comment, and not acknowledge or settle it without your consent where that is reasonable for us.
- If you are a business: you will defend and indemnify filmaris against third-party claims, damages and reasonable costs (including reasonable attorneys' fees) arising from Your Content, your use of Outputs or your breach of these Terms, unless you are not responsible for the infringement. We will notify you promptly, let you control the defence and cooperate reasonably; we will not settle without your consent.
14. Term and termination
- The contract runs for an indefinite period. You can terminate it at any time by deleting your account; paid subscriptions end as described in the Refund Policy.
- We may terminate the contract with four weeks' notice by e-mail. If we do so without cause, we refund unused paid credits and the unused part of a prepaid period.
- Either party may terminate for good cause without notice — for us in particular a serious or repeated breach of section 6, after a warning where one is reasonable.
15. Changes to these Terms
- If you are a consumer: changes to these Terms require your consent. We will show you the changed Terms with the changes highlighted at least 30 days before they are to apply and ask you to accept them in the app. If you do not accept, the current Terms continue to apply; if continuing under them is unreasonable for us, we may terminate the contract with four weeks' notice and refund unused paid credits and the unused part of a prepaid period.
- If you are a business: we will announce changes by e-mail at least six weeks before they apply. You may object within this period; if you object, the previous Terms continue and we may terminate the contract with six weeks' notice. If you do not object, the changes apply — we will point this out in the notice. Changes to the main obligations or prices require your express consent.
16. Governing law and courts
- These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory provisions of the law of the country of your habitual residence.
- If you are a consumer, you may sue us in the courts at our registered seat or in the courts of your place of residence where its law allows; we will sue you only in the courts of your place of residence.
- If you are a merchant, a legal entity under public law, or a business without a general place of jurisdiction in Germany, the courts at our registered seat have exclusive jurisdiction; we may also sue you at your seat.
17. Country-specific notices
- Australia: our services come with guarantees that cannot be excluded under the Australian Consumer Law; nothing in these Terms excludes, restricts or modifies them.
- New Zealand: nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986; if you acquire the Service for business purposes, the Consumer Guarantees Act does not apply.
- United Kingdom: nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015; you may bring proceedings in the courts of the part of the UK where you live.
18. Final provisions
If a provision of these Terms is invalid, the remaining provisions stay in force. The English version of these Terms is authoritative.
